Hushmail Opens Emails To US DEA

It appears that Hushmail isn't quite as secure as it was initially thought to be.

Up to this point, it was thought that Hushmail was completely secure as messages were stored encrypted. Indeed Hushmail used to boast that not even their engineers would be able to read messages of users. A Californian court has recently heard how the Drug Enforcement Agency (DEA) made a request - via a court order - to the Hushmail operating company to turn over emails of three Hushmail accounts, they agreed and delivered 12 CDs full of emails. So how did the DEA get access to the clear versions of the email?

There's two front ends to Hushmail, one where the message is encrypted at the client end using a Java client, the other runs on the Hushmail servers via a secure SSL connection.

An Arizona appellate court today joined a growing judicial consensus recognizing the need to protect the anonymity of online speakers from overreaching discovery requests.

Mobilisa, a Washington-based communications company, went to court last year to seek the identity of an individual who had obtained an email initially sent by company's CEO to his mistress. The individual forwarded the email to company employees. A lower court agreed to issue a subpoena requiring Doe's ISP to reveal Doe's personal information. Doe and the ISP, represented by longtime EFF cooperating attorney Charles Lee Mudd, Jr., immediately appealed. EFF and Public Citizen (with help from Arizona attorney John Flynn) filed an amicus brief in support of Doe, pointing out that strong protection for the right to engage in anonymous communication--to speak, read, listen, and associate without revealing your full identity--is fundamental to a free society.


ISPs raided over file-sharing

The music industry's anti-piracy unit claims 50 file-sharing hubs in Australia closed down this week following its raid on internet service provider Swiftel Communications for alleged copyright infringement issues.

On Wednesday, Swiftel - which allegedly owns and operates computer infrastructure hosting web pages that employ the BitTorrent file-sharing software - was ordered by the Federal Magistrates' Court to take down any sites containing material which infringes copyright.

Music industry piracy investigations (MIPI) general manager Michael Speck said a survey carried out by the anti-piracy unit's computer forensic experts revealed a dramatic reduction in the number of active file-sharing hubs.

Speck said 50 of the 63 websites which fell within MIPI's "investigative threshold" had shuttered.
