France cracks down on illegal file-sharing

Internet users in France who frequently download music or films illegally risk losing web access under a new anti-counterfeiting system unveiled on Friday.

The three-way pact among ISPs, the government, and owners of film and music rights is a boon to the music industry, which has been calling for such measures to stop illegal downloads eating into its sales.

Under the agreement � drawn up by a commission headed by the chief executive of Fnac.com, one of France's biggest music and film retailers � service providers will issue warning messages to customers downloading files illegally.

If users ignore those messages, their accounts could be suspended or closed altogether.

"We run the risk of witnessing a genuine destruction of culture," French president Nicolas Sarkozy said in a speech endorsing the deal.

Well, it's almost time for me to head off to Australia. Tomorrow, actually, but this might be my last chance to get in a blog before then. I will try to blog while there but won't promise. Christmas is over and it was quite a pleasant one. My son visited from Las Vegas and he said he had a good time. It looks like he is set on going back to college full time to qualify as an accountant. He did one class last semester and got an A, so it looks like he should do OK in that field. He has quite a bit of money coming to him for education from the time he spent in the United States Air Force; at least enough for about two years of college. We spent Christmas Eve morning at my wife's parents then headed to Pensacola Beach, Florida to where my wife's sister and family live. Lots of gifts were handed around and we all ate and drank too much.

Cablevision Fights DVR Ruling

Cablevision Systems's long-awaited appeal of a lower court decision that effectively squashed its efforts to introduce a network digital video recorder inched forward last week, after the cable company filed a brief in with the 2nd U.S. Circuit Court of Appeals in Manhattan.

Cablevision's argument to reverse the lower-court decision — made on March 22 by U.S. District Court Judge Denny Chin — came as no surprise. While the 77-page brief cites dozens of cases, it appears that Cablevision's main argument is that Chin's ruling flies in the face of the landmark 1984 Supreme Court decision — Sony Corp. of America vs. Universal City Studios — which allowed consumers to buy and use videocassette recorders.

While the Cablevision brief argues each point of Chin's ruling, the judge's main objection to the product — called the Remote Server-DVR — was that it violated copyright law because the cable company had physical control of the servers that perform the actual recording, despite Cablevision's claims that customers control the recording and playback of shows.
